WHO CAN SMOKE RECREATIONAL CANNABIS? WHAT IS THE MINIMUM AGE?

Anyone 21 years of age and older can consume recreational marijuana in the state of Oregon. The use of or possession of marijuana by anyone under the age of 21 is illegal — This includes home consumption.




HOW OLD DO I HAVE TO BE TO VISIT EMERALD TRIANGLE TALENT?

You must be 21 years or older with a valid, unexpired, and unaltered, State issued ID to enter all Oregon dispensaries.




I’M A REGISTERED OMMP PATIENT, BUT I’M ONLY 18 YEARS OLD. CAN I STILL BUY CANNABIS FROM AN OLCC RETAILER?

OLCC licensed retailers can sell cannabis for medical purposes to anyone over the age of 18 with a valid OMMP patient card.




IF I FORGOT MY ID OR AM NOT 21 YET BUT WANT TO JUST LOOK AROUND, CAN I?

No. You must be 21 years or older with a valid, unexpired, and unaltered, State issued ID to be in any Oregon dispensary.




WHAT FORMS OF ID ARE ACCEPTED AT EMERALD TRIANGLE TALENT?

In order to enter ANY Oregon dispensary or buy cannabis you must present a valid piece of State issued Identification.

Per OLCC guidelines the following are considered valid forms of ID:

· A non-digital, unexpired, and unaltered U.S. state or District of Columbia driver license.

· An unexpired and unaltered ID card issued by a U.S. state, District of Columbia, Puerto Rico, Guam, Northern Mariana Islands, United States Virgin Islands, or American Samoa, with photo, name, date of birth, and physical description.

· An unexpired and unaltered ID card issued by a federally recognized Indian tribe with photo, name, and date of birth.

· An unexpired and unaltered passport or unexpired and unaltered passport card.

· An unexpired and unaltered U.S. military ID card.

*If you are traveling from another country outside of the United States you will need to present your passport. Nexus cards cannot be accepted.

CAN OREGON RECREATIONAL CANNABIS BE TAKEN TO STATES WHERE CANNABIS IS ALSO LEGAL?

No. Taking cannabis across state lines is a federal offense, this includes air travel.





WHY CAN’T I PURCHASE CANNABIS WITH A CREDIT CARD?

As long as cannabis remains illegal at the federal level, banks will refuse to allow dispensaries to accept credit card transactions as a payment option and often refuse to allow cannabis businesses banking accounts at all.

The Federal Deposit Insurance Corporation (“FDIC”) is an independent governmental agency that provides deposit insurance for up to $250,000 per depositor to eligible banks and savings associations. The most dangerous risk that a bank faces when conducting business with a state-licensed marijuana business is the possibility of losing its federal deposit insurance. Simply put, a bank will fail without membership to the FDIC.

The threat of exposure to such a risk will always be an important consideration for any federally insured bank doing business with a state-licensed cannabis business.


CAN I SMOKE CANNABIS IN A BAR/RESTAURANT?

Cannabis cannot be smoked or used in a public place.

The OLCC considers any establishment with a state liquor license to be public, including patios or decks set aside for smokers.

Allowing cannabis use may put an establishment’s liquor license in jeopardy. In addition, smoking and vaping in most businesses is limited by the Indoor Clean Air Act.





WHERE CAN I SMOKE OR USE RECREATIONAL CANNABIS?

Cannabis cannot be smoked or used in a public place. Oregonians are allowed to grow up to four plants on their property, possess up to eight ounces of usable cannabis in their homes and up to two ounces on their person. Recreational cannabis cannot be sold or smoked in public.


WHAT IS THE DEFINITION OF A PUBLIC PLACE?

A public place as defined by OLCC Regulations and Oregon State Law is; “a place to which the general public has access.” This includes, but is not limited to, hallways, lobbies, and other parts of apartment houses and hotels not constituting rooms or apartments designed for actual residence. Highways, city streets, schools, places of amusement, parks, playgrounds and premises used in connection with public passenger transportation.

In addition, smoking and vaping of any kind within 15 feet of any business is limited by the Indoor Clean Air Act.




CAN I GET A DUII WHILE UNDER THE INFLUENCE OF CANNABIS?

Current laws for DUII have not changed. Driving under the influence of intoxicants (DUII) refers to operating a motor vehicle while intoxicated or drugged, including impairment from the use of cannabis. In addition, Chapter 475B requires OLCC to examine, research and present a report to the Legislature on driving under the influence of marijuana. The OLCC will do this in conjunction with the Department of Justice Criminal Investigation Division and Oregon State Police.
